Driver's License Suspension Police
At the time the officer has arrested and booked you for a Los Angeles DUI, he or she will hand you an order suspending your driver's license, effective 30 days from the date you are served. If the chemical test indicates that your blood alcohol content (BAC) is above .08%, then the officer will immediately confiscate your driver's license, and you will be issued a pink piece of paper called an Order of Suspension. The length of the suspension will depend on a number of factors and the skills of your Los Angeles DUI attorney:
- Have you previously been convicted of a DUI?
- Was there a refusal to comply with a blood, breath, or in the case of drugs, a urine test?
- Was your BAC more than .15%?
- Was there an injury to a person at the time you were DUI?
- Were you speeding more than 30 MPH over the posted speed limit on a highway or more than 20 MPH over the speed limit on a city street?
- Were you 14 or younger at the time you were arrested for DUI?
This Order of Suspension is considered a formal notice of suspension, as well as a temporary license valid for 30 days. You must request a DMV hearing to object to the suspension with 10 days.
The length of the DMV suspension will usually last 4 months. The length may be reduced, but it will be a very restricted license that allows you to drive to work, school or necessary appointments only. However, the DMV requires a minimum of 1 month full suspension. In order to qualify for a restricted license, you will need to provide proof of enrollment in a DUI alcohol school and proof of insurance. However, if you refused to submit to a chemical test, the suspension is for 1 year and you cannot get a restricted license.
